IMPORTANT: PLEASE READ THIS EULA CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING THE POOL MASTERS MOBILE APPLICATION ("APP"). BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT DOWNLOAD, INSTALL, OR USE THE APP.
a) License: Subject to the terms and conditions of this EULA, Eyeball Games PTE LTD ("Eyeball Games", "we", "us", or "our") grants you ("User") a non-exclusive, non-transferable, revocable and limited license to download, install, and use the App solely for personal and non-commercial purposes on a compatible mobile device owned or controlled by you or on a website which may also include the services available through the App (“Services”). The aforementioned license does not grant you any ownership right over the App or its content or any software used to run or operate the App. The download, installation and/or use of the App does not lead to ‘sale’ of the App.
b) Eligibility: In order to download, install and use the App, You need to be of a majority age in the jurisdiction where You reside. If you are below the majority age, we recommend that you obtain permission from your parents or legal guardian (“Parents”) to play our Games. You should also read this Policy with your Parents so they can help you understand anything you may not understand. If you are a Parent and are concerned about your Child’s use of our Games or have any questions, you can contact us using the details in section 18 below.
c) Restrictions: You must not misuse this App or the Services. This means that you must not (among other things):
d) Registration and Accounts: You are solely responsible for keeping your login credentials that you use to login on the App safe and secure. You shall not share these details with a third-party and shall not allow any third-person to access your account. You acknowledge and agree that Eyeball Games may access your account and/or suspend/terminate Your account, in the event, there is any suspicious activity detected from Your account.
This EULA will automatically terminate upon your breach of any of its terms. Eyeball Games also reserves the right, at its sole discretion, to terminate this EULA and your access to the App at any time without notice. Upon termination, you must cease all use of the App and delete and uninstall it from your device.
THE APP AND THE SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. EYEBALL GAMES DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. YOU AGREE THAT YOUR ACCESS AND USE OF THE APP AND THE SERVICES ARE AT YOUR SOLE RISK AND YOU SHALL NOT HOLD EYEBALL GAMES LIABLE FOR ANY CONSEQUENCE ARISING OUT OF YOUR USE OF THE APP AND SERVICES.
EYEBALL GAMES WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO THE USE OF THE APP, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
THE AGGREGATE LIABILITY OF EYEBALL GAMES ARISING FROM THIS EULA SHALL NOT EXCEED THE ACTUAL AMOUNT RECEIVED BY EYEBALL GAMES FROM YOU.
The App, including all intellectual property rights therein, and all the logos, trademarks, content, images and information on the App along with all features, functionalities and source code, are the sole and exclusive property of Eyeball Games or its licensors. You acknowledge and agree that all intellectual property rights, including copyrights, trademarks, patents, trade secrets, and all other proprietary rights, in and to the App are and will remain the sole and exclusive property of Eyeball Games or its licensors. You shall not copy, reproduce, modify, alter, tamper with the App in any manner whatsoever.
Eyeball Games may use third-party service providers to make available some features and/or functionalities of the App to You. You agree and acknowledge that such third-party service providers, if any, shall have the full title, rights and interest to the intellectual property owned by them and You do not acquire any right, title, ownership or interest in any such component.
The App may contain some third-party links. Any consequences arising out of clicking and/or accessing such third-party links, shall be at Your sole discretion and You shall not hold Eyeball Games responsible for any website accessed through the App.
The App and the content contained therein may include content from third parties (“Third Party Materials”). You acknowledge and agree that You shall not hold Eyeball Games liable for such Third Party Materials and their accuracy, veracity and legality. Eyeball Games does not warrant the safety of such Third-Party Materials. You are solely liable to assess and evaluate such Third-Party Materials before using/accessing/clicking on them. Eyeball Games shall not be liable for any direct or indirect consequence arising from or connected with such Third-Party Materials or use/access of the same.
You may come across or access personal data of other users while using the App. You acknowledge and agree that You shall not unauthorisedly disclose or misuse this Personal Data for any other purpose. You shall not use this personal data for any unlawful or illegal purpose.
You agree to indemnify, defend and hold harmless Eyeball Games and any of its affiliates, employees, contractors, professionals and consultants (“The Indemnified Party”) from and against any claims, damages, cost, liabilities and expenses (including, but not limited to, legal expenses) arising out of Your a) Breach of any applicable law and/or b) Illegal or prohibited use of the App and/or its services and/or c) Any third-party claims Eyeball Games may face as a result of any act or omission by You and/or breach of these terms of use.
The App may offer virtual items or in-app purchases ("In-App Purchases") that can be used to enhance your gameplay experience. In-App Purchases are made with virtual currency ("Virtual Currency") which may be earned or purchased within the App. Virtual Currency and In-App Purchases are for your personal, non-transferable use within the App. You may not sell, barter, or otherwise transfer accounts to circumvent normal Virtual Currency transfers in the App. The Company reserves the right to modify the pricing of In-App Purchases and Virtual Currency at any time.

As part of our commitment to innovation and user experience, we have formulated a policy to govern the integration of NFTs and tokenized assets within our mobile games. Our goal is to strike a balance between empowering players with ownership and ensuring transparency. By adhering to these guidelines, we aim to foster responsible usage of blockchain technology while enhancing user engagement through unique NFT rewards. Eyeball Games reserves the right to modify this EULA at any time by posting the revised EULA on the App or on its website. You agree to be bound by the revised EULA by continuing to use the App after the revised EULA is posted.
The waiver of any default or breach under this Agreement by Eyeball Games shall not be construed to be a waiver of rights or remedies as available under this Agreement.
If any part of this Agreement becomes illegal, invalid or otherwise unenforceable, then that part of the Agreement which has become so illegal, invalid or unenforceable shall be deemed to be severed from the rest of the Agreement without affecting the validity or enforceability of the rest of the Agreement.
Acts of God, fire, earthquakes, strikes, technical defects, government laws and regulations, pandemic, epidemics and any other event that cannot be reasonably foreseen shall be termed as Force Majeure events. Eyeball Games shall not be held liable for any of its obligations that it cannot perform on account of a Force Majeure Event.
This EULA shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of laws provisions. You agree that any legal action or proceeding arising out of or relating to this EULA shall be brought exclusively in the courts located in Singapore, and you hereby consent to the personal jurisdiction and venue of such courts.
This EULA is also intended to comply with the laws of Singapore, the United States, the European Union (EU), including the General Data Protection Regulation (GDPR), and Australia, including the Australian Consumer Law (ACL).
